Otherwise, sliding-scale clients are accepted only by direct inquiry, and not by referral from any other attorneys.  Referrals from other attorneys are charged $260.00 per hour unless otherwise agreed.  

 

Mr. Lee reserves the right to require a minimum retainer sufficient to cover expenses and reasonably anticipated fees in any matter, regardless of rate.  For a new divorce, Mr. Lee generally requires a minimum retainer sufficient to cover twenty (20) hours and anticipated expenses.  For a new paternity matter, the minimum retainer generally must cover at least ten (10) hours and anticipated expenses.  The retainer in other matters will be determined based on a reasonable estimate of time to be expended.

 

Retainers are not a “flat fee.”  If reasonable hours of work or expenses go beyond the retainer, Mr. Lee may require the payment of an additional retainer, regardless of whether a monthly payment plan has been discussed.

 

Mr. Lee does not control the Court’s docket on any given day, nor the cooperativeness of opposing parties and counsel.  Crowded dockets and obstructive litigants may increase the hours Mr. Lee must expend on your case.

 

In order to qualify for these reduced rates, the potential client must provide a copy of his/her four most recent pay stubs and prior year’s W2/Forms 1099, or other evidence of income and assets satisfactory to the attorney.  In addition, the potential client must complete a Rule 401 Financial Statement, disclosing all assets available.  Download a Financial Statement.

 

Attorney Lee may in his discretion refuse to apply a reduced rate if the client has substantial funds available despite a reduced income.  If at any time the attorney reasonably determines or a Court finds that the client has misrepresented his or her income or assets, the hourly rate may and shall be raised to the maximum rate of $260.00 per hour.
